I'm in the process of getting a divorce, can i change my last name to my fiances name for the sake of our baby that will be born in a month?

As part of a divorce action you may resume you maiden name.

Assuming you want to do this at minimal cost why not do the following.

List your fiance on the birth certificate and give the child the father's last name. Once you marry your fiance then you adopt his name. At that point you, dad and child have the same last name.

I think that will accomplish what you desire. Even better it shouldn't cost you anything.
