I have been separated from my husband for 12 years now. Do I still have to file or am I considered legally divorced?

In order to get remarried legally you have to file. If your husband agrees to it, you can have this done fairly quickly.

You will still have to file for a divorce and can do so on the grounds that you have been separated for more than 2 years. It will have to be filed and served upon your husband.
