Legal Question in Family Law in Pennsylvania

Divorce

I have been separated for 15 years. I filed for divorce two times over this time but my wife always comes up with something to delay. We had no property or minor children. Can I petition the court on my own to get a judgement even if the original petition for divorce was so long ago?

Re: Divorce

Depending on the grounds you stated to get a divorce you can move forward without her.

In your divorce complaint if you claimed that you want a divorce on the grounds of 2 years separation you can file your affidavit of separation. Once that's filed you wait 20 days and serve her with a counter-affidavit. If she fails to respond in 20 days you will need to show the court you sent the counter-affidavit then you can file the paperwork to have the divorce made final.

If you have any questions feel free to contact me. The initial consult is free.
