Legal Question in Family Law in Pennsylvania

Divorce and spouse's student loans

I am in a divorce, my spouse took out student loans in twice the amount of the schools cost. Now she wants me to pay for half of the current loan balances. I never saw any of the additional cash and did not know she took the loans out. Can I avoid paying on the loans or can I sue her outside the divorce?

Re: Divorce and spouse's student loans

Both debts and assets are subject to equitable distribution. Depending on what sort of schooling the loans were for will effect who will have to pay them back. The fact that she took out the loans in her name and did not inform you of them may also help your case.
