Legal Question in Family Law in Pennsylvania

Divorced or Not?

I was married in 1988 and legally separated in 1996. Formal child support and legal separation papers were drawn in the state of TN. I moved to PA in 1996 and divorce proceedings were halted. My ex moved to VA. Our divorce was never finalized because our residencies changed. However, he recently remarried in VA without us being divorced. Can I suffer any adverse repercussions as a result? Is there any way I can find out if he legally married or if I am divorced and not aware of it? The new wife has a drivers license in his surname and has been added to his health insurance. Do states check divorce records from other states before issuing marriage licenses? Someone said failed attempts to serve could result in divorce. Any truth to this?

Re: Divorced or Not?

No you won't suffer. Your HUSBAND on the other hand will problems. Most notably he is committing bigamy.

It was up to your husband to prove he was free to marry. Its up to the issuing office of the marriage license to check. Do they? Usually they do. Do they miss some prior marriages. Unfortunately the answer to that is yes.

Failed attempts to serve = divorce. Really, did a lawyer say that?
