Legal Question in Family Law in Pennsylvania

Dna testing

My husband had an affair. The woman is married and wound up pregnant. She is telling my husband that the baby is his. Can he make her take a dna test? Also how does he go about this?

Re: Dna testing

You asked about an alleged biological child.

The husband cannot force the mother to have a DNA test. Her allegation that the pregnancy is his child is insufficient.

Once the child is born then the mother can make a claim against the alleged father. If the alleged father disputes the claim then the mother can then get seek an order to get a DNA test. If on the other hand the father seeks to assert rights then he generally can only do so after the child has been born and where the child has NOT been born to an intact marriage.

As you can see, this can get messy. You should seek counsel to guide you in this matter.

Regards,

Roger
