If you have both been charged with a summary offense you both have to appear in front of the District magistrate.

Whether you get a lawyer is up to you.

It doesn't matter if your husband "can't remember" the police officer involved will be there and he will be testifying from his report.

As for you testifying there is no spousal privilege that only applies to verbal communication between spouses.
