Legal Question in Family Law in Pennsylvania

domestic dispute

My husband and I had a domestic dispute and both received a notice of trial summary case. My question is do I have to testify against my spouse? Do I have to show up? Should we get a lawyer? I spoke to the DA and she told me nobody would be arrested or have a criminal record but my husband may have to pay a fine. Can my husband say he doesn't remember anything? Please help.

If you have both been charged with a summary offense you both have to appear in front of the District magistrate.

Whether you get a lawyer is up to you.

It doesn't matter if your husband "can't remember" the police officer involved will be there and he will be testifying from his report.

As for you testifying there is no spousal privilege that only applies to verbal communication between spouses.
