Legal Question in Family Law in Pennsylvania
Employer Not Sending Child Support to Family Court on time
I had a court-ordered wage attachment for child support for my 3 children. My employer deducted the money weekly from my paycheck. However the money was not sent to family court weekly and I was frequently in arrears and didn't know it. Isn't it illegal for an employer to withhold this money for weeks at a time without my knowledge? My tax refund was intercepted almost every year because of this and my employer didn't seem to care. I have since been laid off because family court threatned to fine my employer about the continual deliquencies.

You asked about problems with a court-ordered wage attachment.
If you were laid-off because of the wage attachment then you may have a claim against the employer for that act itself. Further, yes, you probably do have a claim against the employer for any damages that resulted from their failure to properly collect and pay the garnishment.
You need to speak with an attorney to properly evaluate these matters.
