Entitlement to Husband's Workmen's Comp Settlement Prior to Divorce

My husband has been collecting Workmen's Comp prior to our separation in November 2000. He has recently made a Settlement with his employer. As we are not yet legally divorced, am I entitled to a portion of his settlement.

The question of disablity payments is not completely clear. Generally, with Workman's Compensation commutations, if a claim arose during the marriage, it is marital property.
