Legal Question in Family Law in Pennsylvania
Establishing Paternity
My ex girlfriend had a baby a couple months ago. I broke up with her about seven months before the baby and I decided not to see the baby because I thought it was in the baby's best interests since we were no longer together. She started dating an old boyfriend a couple months before the baby was born. Since I wasn't going to be in the baby's life HE signed the Paternity Papers. I have not seen my child or paid support but am having second thoughts I can challenge paternity can't I even though he signed those Acknowlegement of Paternity forms since we all know he is not the biological father?

Re: Establishing Paternity
Yes you may challenge paternity but this should be a considered decision made only after consulting with an attorney skilled in family law.
Even where paternity is accepted it can be challenged except in where the child is born in wedlock. Then the mother's husband is automatically assumed to be the child's father. There are narrow circumstances where this may be challenged but that discussion isn't appropriate here.
Be aware that challenging paternity can be a drawn out process and will entail financial support through at least the age of 18.
This may be a rewarding path for you to follow but it must be taken only with the legal and financial guidance of professinals who have seen such matters previously.
Regards and good luck.
