Legal Question in Family Law in Pennsylvania

My ex-husband does not pay child support for our daughter (there is no agreement for him to pay). We've been divorced for three years. He is a student and claims he cannot pay, however I need him to help out. I would like to file for child support, but before I do, I wanted to make sure he cannot come after me for any kind of spousal support. I make more money than he does, but not alot - less than $40,000 per year.

If you have been divorced for 3 years, he cannot come after you for spousal support, as you are not married. They should argue that he has an earning capacity to pay.
