Legal Question in Family Law in Pennsylvania

My ex-wife is moving to South Carolina with our two children. We have been working on a custody agreement for a year, but have nothing signed, what rights do I have to keep her from taking the children to South Carolina.

You need to file a petition in the Court of Common Pleas in your county. As long as they haven't lived in South Carolina for 6 months jurisdiction is in Pennsylvania. That said your right to prevent the move will require you to file either before she moves or very soon after she moves.

PA has jurisdiction as long as the kids have been here for at least 6 months. You can file a custody complaint in the county you live in. You would also have up to 6 months to do so should be move, but it would be better to do so beforehand. The burden would be on her ot show why she should be permitted to relocate out of state.
