Legal Question in Family Law in Pennsylvania

Ex-Wife Petitioning for More Child Support

Can an ex-wife petition for more child support if she is not working by her own choice? My husband's ex has not worked in 5 years even though one child is not at home, one is graduating high school in May and the last child is a high school sophomore. His ex has an 8 year old son w/her current husband but he is in school all day too. Other than being lazy there is no reason why she can't work. Shouldn't she be responsible for the support of the children as well since she has custody and my husband hasn't been allowed to see them or talk to them?

Re: Ex-Wife Petitioning for More Child Support

It sounds like she should be given an earning capacity. She has the ability to earn and contribute to the needs of the child.

Call for more information.
