Family financial agreement

I have agreed to give my son a considerable amount of a down payment for his first home. He is married. He and his wife have agreed that if the marriage should end My downpayment would be distributed to me first before any other ditribution in a settlement between them concerning the house. Is there any legal document I can use to get this in writing and signed by all three of us?

The legal document you're thinking of is a promissory note. In your case this would require a fair amount of change to one you might find online. Also, its a contract and as such if there is any lack of clarity or vagueness then it will be interpreted against the drafter.
