Family Law - Step parent's custodial rights of minor
My exhusband & father of my children died in Feb 2007. We shared joint legal custody and 50/50 shared custody of our 3 children for most of the 8 yrs we were divorced & lived within 5miles of each other,so the kids could go back & forth & spend as much time as possible with their dying father - diagnosed with a brain tumor 5 yrs ago. He had also remarried in 1999-a woman with 3 children of her own. They had no children together. My children are now 20, 17 and 10. His will (drawn up just before his 1st brain surgery 5 yrs ago) gives everything (est500K -$1MM in assets) to the 2nd wife - nothing to his children. While sad & devestating for lack of thought of them by their father - a college trust fund for $200K suit that was part of our Seperation decree - is being litigated.
The latest filing by my dead husband's 2nd wife - is for partial custody of my 10 yr daughter. The target appears to be to get Soc Sec benefits-she can no longer collect on my daughter's behalf & to harass me . She claims due to the stepmom relationship. They have seen each other 5-7X since Feb. Our family psychatrist will testify that it is not in my daughter's best interest to have contact w/ stepmom Q-Can I get free legal aid to defend my children's rights?

Whether you can get free legal services is up to the provider of such services in you county. They name and number should be on the notice to defend that came with step mom's latest filing. Other wise you should call you county bar association they will know who provides free legal services or if you don't qualify, reduced cost legal services.
