Legal Question in Family Law in Pennsylvania

Father giving up parental rights

The father of my child wants to sign away his parental rights. He does not want the child. Is he able to voluntarily terminate his parental rights? Would I have to agree to this?

Also his mother says that if her son has nothing to do with teh baby whether he signs away his rights or simply ignores her, that she still wants visitation. Would I have to allow her visitation? Would this be a court matter?

Re: Father giving up parental rights

He can voluntarily give up rights to visitation and custody by merely never going to court to exercise them.

What neither you and he can NOT due is give up your child's right to support. Absent an adoption he is on the hook to support the child until the child's 18th birthday.

Re: Father giving up parental rights

The only way for a parent to voluntarily terminate their rights and therefore their obligations is if there is an adoption typically by a step parent. If rights are terminated then the right to visitation is typically lost. I offer free consultations.
