Legal Question in Family Law in Pennsylvania

My father recently informed my mother after 50 years of marriage he no longer wants to be with her. He wants her to leave, but he wants to keep the house. Although, the house is in both of their names. What will my mother need to do in order to sell the house? Will she need to initiate a divorce or will my father need to buy her out of the house?

Divorce complicates the situation and the resolution of the house may have to be decided by the courts unless the parties can reach an agreement. Generally borrowing a Court Order if the property is in both names both parties must agree to sell or transfer the property. A divorce would provide a means for judicial action if necessary regarding the house. If your father wants to keep the house this will have to be resolved through the divorce. I suggest your mother consult with an attorney to further review her situation.
