Father seeks physical custody

My boyfriend and i currently have his 7 year old daughter for the second time in less than a year, due to the fact her mother cant handle her bad behavior. She has called and said come get her both times. The custody papers still state she has primary physical. His daughters behavior problems are due to the mothers care or should i say not care. She was molested 2 years ago while her mom was in the house. She is on stratera at this time. She has seen multiple couselors during the process. Most of which her mother hasnt finished. Those that were finished have recommended our home to be much more stable. We are going to attemp custody. What are our chances and if the mother doesnt like the idea what are her chances of taking her home during the process sense the custody papers do state she has primary physical. His daughter wants to be here.

The mother would be entitled to custody if she choose. You might want to consider filing the custody petition on an emergency basis.It would certainly speed up the process. I offer free consultations.
