Father's name on birth certificate

My daughter is pregnant to, married to, but separated from a man on social security disability for mental health issues. If he agrees to put his name on the birth certificate as the father, does that give him rights to have the baby? We want nothing to do with him. He is CRAZY and we wouldn't trust the baby with him alone. Would it be better NOT to have his name on the birth certificate as the father?

Assuming that your daughter became pregnant during the marriage, and prior to separation, the court will presume that her husband is the father of the child. He has custodial rights as a father, should he choose to seek them. He is also liable for support of the child, regardless of whether he seeks to exercise custody. Your daughter should consult with an attorney so that all of the facts regarding the issue are presented. A consultation will enable you all to make decisions based on an accurate understanding of your daughter's rights and the rights of her husband.
