My son was borned 4 weeks ago and even though i am not married to my girlfriend we,did fill out the AOP form and sent right away.

My question is a couple of days ago my girlfriend was picked on a warrant charges and don't know when they will release her.

I was told by the police officer that i have no legel rights to my son,and that my girlfriends mother will have full custody.

I am listed as my son's father on the birth certificate and with my last name.(we are both over 21)

Her mother will not give me my son and i don't know what to do.

Can you give me some advise?

You, the father, asked about obtaining physical custody of a child where the custodial mother is unavailable.

You really need to consult with a local attorney to enforce your parental rights.
