Legal Question in Family Law in Pennsylvania
No fault divorce, living in the same household after filing divorce 2 years ago.
I am a plaintiff in divorce that was filed over two years ago and I am living with my wife who is contesting the divorce. We have been living together separately under the same roof. We do not have intimate relations, we do not sleep in the same bedroom together, but I have attended family gatherings with her, ate dinner at home with my wife and in restaurants with friends and my wife. She is disabled and so that is why I have remained in the household - though I want a divorce. I am also paying all the bills, and she does get her own disability payment each month that she spends on her pets. We have a pre trial hearing with the Master attorney in two weeks, but there is a chance that I may not be granted a divorce based on two year living separate and apart because I have remained in the house. I have spent alot of money to date on the proceedings. What can I do if the master will not rule in my favor to obtain a no fault divorce? My wife has not retained a lawyer either- though she has participated in the telephonic conference and one prior meeting with the master. I have only attended functions and social gatherings as a favor to her to help her due to her disabilities. What can I do to speed up this? She will not divorce me!

If you have spent a lot on the proceeding to date, I will assume you have counsel. If you do he's the one who can best answer your questions.
The law does allow you to live separate and apart under one roof.
If you have any questions feel free to contact me. The initial consultation is free.
