Legal Question in Family Law in Pennsylvania

No fault divorce

I'm living in Pennsylvania. I left my wife in 2005 and have been living here ever since. We were married in Toledo, Ohio in 2001. She still lives there. The problem is, I have all the divorce papers written up and signed. I just yhave to file them. When I called the court house in Toledo, they told me I could file my papers here in Pennsylvania. Is this true? I could file here and the judge could grant the divorce even without her showing up? There are no children or issues with money. We just want a divorce but she says I have to file the paperwork. All the paperwork I have signed is written up for the court house in Toledo, Ohio, although, if I can file them here, I could just retype up the papers and have her resign them. I just don't have time to get back to Toledo to file the papers, so I'd like to file them here if possible.

Yes you can file in PA. You have lived in PA for more than 6 months.

Well because the laws in Pennsylvania are substantial different than Ohio its going to take a bit of doing to get the paper work done right not just retyping them. As long as your wife will consent to Pennsylvania jurisdiction you can file in Pennsylvania, you meet the residency requirement.

I see 2 potential grounds for getting a Pennsylvania divorce, consent and separation. As you meet the 2 year separation requirement you can get on those grounds. Be warned its not as easy as it looks. I just had opposing counsel screw up the paperwork.
