Legal Question in Family Law in Pennsylvania
My fiances "soon" to be ex wife is dragging her feet about signing the divorce papers. They were married in Penn. 25 years ago. They have been physically seperated 5 yrs. ago. ~ Legally 2 1/2 yrs. ago.
She has filed for divorce but will not sign b/c of our wedding plans. He gave her everything. There is NOTHING to contest. She has said she will sign before....... she keeps coming up with a reason why not to. Penn. law states that either has up to 2 yrs past the LEGAL seperation date. (Which has passed now.) What avenue can we take to get a bit if leverage? Yes, she SCORNED, and SPITEFUL, even though she fikled for the divorce in the first place!! Jeanie

I cannot ethically discuss your finance's situation with you. However, to the extent I am advising you, know that your fiance cannot get married to you unless and until he is divorced. The divorce can be bifurcated - meaning the divorce can be granted while property issues can be resolved later. That way, the divorce and impending wedding will not be held hostage. As your fiance has been separated for over 2 years, it is time to move this along. Seek bifurcation and get the divorce granted at least. If the parties cannot equitably divide their marital assets and debts and resolve any alimony issues, then the court will have to decide those issues. Your fiance needs a family law attorney now.
