Are there any prior custody orders? How did the father get custody? Where does the child live at now? Child custody is based on the best interests of the child. Regardless of what you think, the issues are going to be whether it is in the child's best interests to remain with his father or be transferred to you.
If there is a prior custody order, then petition the court to modify the order based on changed circumstances, i.e., that the father is not properly caring for the child. If there are no custody orders, then petition the court for custody of the child.
