fighting for Custody while in the military

Can a soldier fight for legal custody of his child if he is being deployed to Iraq? Afriad ex will leave the state with child while he is gone. His father is POA for everything but his son.

Yes he can. The grandfather, the agent for the soldier may initiate the action. How far it gets may be determined by service member relief act. The court could stay the action and order mom to stay put or leave the child in the court's jurisdiction.
