Legal Question in Family Law in Pennsylvania

Can I file for Child Support

My spouse has a child from an affair. My spouse is paying a large amount of child support for this child which leaves barely no money left to cover bills and support our family. Can I fille for child support even if my marriage is still intact so that my family is not suffering. I thought that the courts treat each child equally. when the mother of this child took my spouse to court to increase support (which they doubled it) my spouse mentioned that he has another child (which is older) they told him it does not matter. So therefore, my child was pushed aside? is this fair? What can I do?

Re: Can I file for Child Support

You cannot file for child support against your husband. Child support is calculated on the statewide guidelines. If they don't take more than half his income there is no deviation for other children.
