I am about to file for temporary/emergency custody of my grandson. pending on the outcome of his parent's ultimatum. I will be picking my grandson up today to care for him for the next 3 days, as they are too tired (severe drug use). If the ultimatum results in my filing for emergency custody, am I able to keep custody of my grandson while the order is processed or will their be legal repercussions if I do not return him to his parents?

Grandparent cases often times can be very difficult. Not every grandparent can sue for custody. A grandparent can only sue for custody in certain situations that are defined by statute. There are not enough facts here to determine whether you will even have standing to sue. Assuming you do, and assuming this is truly an emergent circumstance, you would want to speak with your attorney about filing a petition for special relief, whereby, asking for temporary custody pending the outcome of a hearing.
If you do not have an attorney, I would highly suggest that you retain one before doing anything.
