Legal Question in Family Law in Pennsylvania

how to finalize divorce

My husband filed for divorce after I made him move out due to domestic violence. He later said he didn't want to divorce me after all. In the meantime I received the final papers to sign after the 90 days. I signed them immediately as I want to be divorced. I did not have an attorney since we were not fighting over anything.

It has been about three weeks since I signed and I have not received any final divorce decree papers yet.

I do not know if he signed the final papers or even if he paid his lawyer all her fees.

How can I find out the status? If he now refused the divorce can I go file for divorce? I want this over as soon as possible.

Re: how to finalize divorce

What you signed was an affidavit of consent. Once signed it has to be filed with in 30 days. If not you'll have to sign another. He has to file his affidavit of consent. Once that is done there is generally a waiver of notice you'll have to sign then its up to his lawyer to file all the other paper work to make it happen. How long this will take is dependent on his attorney.

If you have any questions feel free to contact me. The initial consultation is free.
