How can you find out if a legal seperation was filed and if not and your spouce is living with someone else is that considered adultry?

There is no such thing as legal seperation in PA. If the other spouse is living with a member of the opposite that will likely be consideration cohabitation. However, seldom do we argue fault in a divorce complaint. Adultery, however, can be a defense to spousal support and may help prevent an order for alimony. Adultery is not a factor for equitable distribution though.

That said it's only adultery if the committed before the separation.
