Going for Full Custody!

This has nothing to do with me, but my Fiance'. he has split legal custody of his 2 year old son, but he actually wants to go back for full cusotdy because he thinks his ex is doing drugs and is not providing a safe home environment for him, and we know for a fact she is not following the court order, because she has admitted several things to us. How would he go about proving his case and possibly getting full custody of his son?

For starters legal custody, is often shared as it relates to the right to make decisions on the child's upbringing.

What it sounds like is that your Fiance wants primary physical custody.

While it is possible to get it is not going to be easy nor cheap. There is a high burden on the non-custodial parent to prove that the best interest of the child will be served by changing primary physical custody. It is a high burden but not an impossible one.

While you could file a petition to modify custody on your own. I wouldn't recommend it. You need to have the facts and law on your side.
