No full custody on paper

My ex last year said she couldn't handle raising the kids. So she gave my two biological children to me for the last 14 months and sent her older son to her dads. Then she took off for Florida. Worked in a titty bar upset a few people and came back. Anyhow her son wants to come back and she needs money. Given that I was paying 1200.oo in support along with his das payment. My problem is that I don't have custody papers. The last papers drwan up stated that I had them every weekend and one day a week. I am told that I always need her consent for any modification. She abandoned the for 14 months how is that possible. Now I had to give them up because I didn't have custody on paper and there was a court order stating that the children had to attend the school they were attending and I am not a resident of that district. I tried to enroll hiom in my area but the old school said that they wouldn't realease papers because of the court order. However, I commuted the 3o miles round trip all last year even though the school sent me papers saying they were't allowed to attend there. Please..I hope you have advice that could help me out. I am so crushed.

You can file to modify custody based on any substantial change in the conditions that would effect the children's best interest. The facts you describe would constitute a substatial change. I offer free consultations.
