Legal Question in Family Law in Pennsylvania

Future Divorce Question

A little background. No one has any idea I'm considering this at all. I thinking way down the road, my children are 8 and 4, and I am still at home with my wife and the children. If we get a divorce in PA is there any chance my children could come live with me when they get older like their teen years if they want a change? Or do they have to stay with my wife until they are 18?

Re: Future Divorce Question

Who gets custody will be determined when a custody petition is filed or potentially as part of the divorce proceedings. Who gets the children is based on the best interest standard.

As to when do children have a say who they live with. That depends on the judge. Generally by the time they are 16 most judges give weight to what the children want some might do it at a younger age it depends.
