Gaining the Custody of a Minor

My youngest sister is 15 years old. She has behavioral and schooling issues. Our mother, who currently has full custody of her, wants to give me full custody of her because I live in a better environment and I have the time and patience necessary to handle her issues. What is needed for me to be able to gain custody of her? Custody would be willingly turned over from our mother, who has full custody. Her father only has weekend visitation.

Because there is a custody order and even if there wasn't what position does the child father take on your sister living with you as opposed to mom?

If he's agreeable then it will be a lot easier than if he opposes it. Especially if legal custody is shared.

Like many questions I get you don't include a zip code. That's fine but it really helps the lawyer trying to answer the question because sometimes one of the factors is what county in which the case will be heard.
