Grandparents Rights
My 5 yr old grandson stayed w/me every weekend since infancy. The man my daughters remarried is abusive by her own acct & has threatened I will never see my gs again. My gs said he's a bad boy, nobody loves him & specific ways to commit suicide. I filed for visitation & won even tho my daughter told terrible lies about me. Since she didn't have any proof against me she proceeded to make some up. She tried to have me 302d. I was evaluated by 2 drs & released. She called my dr & told him I fled that he should 302 me when I come for an appt. She filed a PFA that went across the desk of the judge that ruled on the visitation. The next day he changed the order to supervised visits with her. At the pre-trial conference the judge said he changed the order based on her allegations, but even if I proved all to be false, he wouldnt change the order back! He said I could go to trial & he still wouldnt change the order. I didnt have the chance to prove my case or to even speak. I feel abused by my daughter & by the judge. When I sent a text message to set up a visit, she threatened me that if I call again she will file charges. Im crushed & dont know where to turn now. How is it legal what that judge did? I spent a lot of money to be abused.

Your case seems to have a long and complicated history, and I can't give a complete answer without reviewing the whole case file and transcripts. However, I'm not sure why the Judge would state that even if all her allegations were false, he still would not give you unsupervised visitation back. The law does give judges a lot of discretion in this area, so it would be very difficult to overturn his decision, unless you get a more sympathetic judge.
