Guardianship
I wish to establish guardianship of my ailing, old mother (nearly 90) who suffers from loss of memory.
My father is still alive and is in agreement. How do I go about establishing guardianship? How long does it usually take? My main concern is being able to pay for her future health care needs should my father become incapatitated or die?

The guardianship process is relatively simple. The Dr. must testify that your parent is incopacitated and not likely to recover. He must also tesify that she requires someone to handle her affaiors and ,make decisions for her.. The Court then appoaints a guardian who may or may need to post a bond. The process takes about a month and will cost about 750 to 1000 for the lawyer plus the Dr.'s charges plus expenses. It is all payable oput of your parent's assets.
