get name off

If a guy was dating someone who was pregnant and later married her and then signed the child's birth certificate when the baby was a few month's (official notaraized paperwork and bith cerrificate updates) how can he get hsi name off the birth certificate now that they are divorced. He signed everythign knowing he as not the father.

You asked about removing one's name from a child's birth certificate.

This is not a simple process. The law does not believe a child should suffer due to the vagaries of the parent's relationship.

A child born to a couple in wedlock is presumed, at law, to be a product of the union. Even where conception took place outside the union.

A non-biological parent would have to petition the court and argue that his name should be withdrawn as the father for good reason. This is not easy and many courts will take a more difficult stance than others. Moreover, often courts will only allow a disassociation when the biological father is properly identified.
