Legal Question in Family Law in Pennsylvania
Harrassing Ex-Husband
My ex husband makes it hard helping to pick up the kids. He keeps trying to bribe me with giving him sex or photos. I have in the past but dont want to fall into his trap anymore. He pays me child support and day acre, although not on the books anymore. I am afraid if I take any action, he will stop paying or not show up for court. Can he use the fact that I gave in before? I am not in financial shape right now and I think he uses that too. He figures I can't afford an attorney and he is right. I appreciate any advice. Tx

Re: Harrassing Ex-Husband
You asked about harassment from an ex-spouse.
What you describe sounds more like sexual abuse and extortion than harassment. You need to speak with an attorney immediately. You should also consider pressing criminal charges.
No man has the right to extort sex for any reason. Period. If he even suggests that he will do ___ if you perform sexually then he is committing a criminal act. It's called solicitation. If he suggests that he will do ____ if you don't perform sexually then that is called extortion and is a crime. Your local police department should be happy to investigate these crimes (but do this through an attorney).
Whether you can afford an attorney or not you can get legal assistance. Start by going to your local women's shelter. They can help you understand your rights and help you get out of this cycle of abuse.
You can also seek legal assistance at one of many local family law clinics in the state. Widener University School of Law has clinics at both the Harrissburg and Wilmington, DE campus and can either help or refer you to assistance.
Since you seem to be divorced, all you really need to do is 1) get an order of support, 2) get an order of custody sharing parenting duties, 3) get full possession and ownership of all photos that he has taken and an injunction from the release of any photos. You could also seek potential civil penalties for the suffering that he has put you through.
Take back your rights. And please let me know how this turns out for you.
