Legal Question in Family Law in Pennsylvania
Hello,
I live in PA and I don't know if my five year marriage is going to turn around. I wanted to know if I got a divorce what my husband would be entitled to. Everything is in my name, cars and house. He makes less money than me and we do have a daughter that we adopted almost two years ago.
I want to protect what was mine to begin with, like my home. Any chance of that? or would I have to pay him alimoney?

Generally all assets acquired during the marriage regardless of how titiled is marital property subject to equitable distribution. there are some exceptions. Assets you owned prior to marriage are non marital property except for appreciation during marriage. What you would be entitled to or your husband should you pursue divorce depends on the facts and a serioes of factors. As for your daughter custody and support issues would have to be determined. Best advice consult with an attorney to get a more precise idea how such a prospective divorce may effect you.
Regardless of whose name the property or debt is in, if acquired during the marriage it is marital. As to how any assets would be divided, that is dependent on a case by case basis and by applying the PA divorce code. As for paying him alimony, that is also dependent on a number of factors, including who is goign to have custody of your daughter. Please call for free consult.
