Legal Question in Family Law in Pennsylvania

Helpless Father

I have a daughter 7 years of age and the mother and I are not together for some time now. She keeps her from me and my family and now she has given custody to her sister. I do have visitation rights. She wants to give her up for adoption to her sister and I won't have it. I really don't have money to spend to go to court, but I WILL NOT let this go. What can I do?

Re: Helpless Father

If there is a custody order in place and mother doesn't follow it she is in contempt. A petition for contempt could ask as remedies that mother pay your attorney's fees. That said there is no guarantee that the court will order that and even if they do that mom could refuse to pay them.

The only way she can put the child up for adoption is to terminate her parental rights and have your rights terminated. To do that if your not willing to voluntarily terminate your parental rights is ask the court to terminate them. If she does you will need a lawyer.

If you have any questions feel free to contact me. The initial consultation is free.
