Legal Question in Family Law in Pennsylvania

hi

got a question about a will..my husband has a child to a former wife....he has had no contact with this child for the last 12 yrs or so. or does he want any contact with him...we want to know if my husband dies...can this child come back on me and demand all of my husbands assests....

we have children of our own..........very concerned..thanks

Your husband needs to make a will and specificially disinherit this child if he is concerned. If your husband does not make a will, then the child of his prior marriage will be able to inherit a share of your husband's assets, but not all of the assets, upon your husband's death as per the intestacy laws of the state where your husband lives at the time of his death.

I would suggest that you and your husband hire a competent estate planning attorney to go over your assets and debts and to make the attorney aware of the fact that the child of the prior wife is not to receive anything.
