HIPPA Law

I have been living separately from my husband since 8/2006. He has the insurance through his employer and receives all of the statement of benefits paid from the insurance company.

Is this not a violation of my rights under the HIPPA law? Through these statements he would be able to still have rights to my personal information.

You signed a release at the doctor's office allowing them to share your medical information with the insurance company. So the doctor is in the clear.

The insurance company has a duty to the policy holder to inform him as to what claims have been paid.

The HIPPA law has no right of private action. That is to say even if it was a violation you could not sue anyone.

Lastly if you were seeking to be paid for expenses not covered by insurance you have to forward the bills so that payment could be calculated.

Bottom line if you want your husband or his insurance company to pay they are entitled to know what they are paying for.
