Legal Question in Family Law in Pennsylvania

If you own a home and it is only in your name, but you are married, does your spouse have any legal rights to that property in case of divorce??

It depends....

Was it purchased during the marriage? Mortgaged?

Did you maintain a separate bank account ( not in joint names ) ?

Did you spouse contribute toward the the mortgage or repairs?

You should sit down with a lawyer and discuss this.

If it was purchased during the marriage, it is marital property. If bought before marriage, then any increase in value during the marriage would be marital.
