Re: house

You asked about selling a house with a spouse refusing to participate.

The matter really needs to be examined closely to determine the best method. In some cases the sale can be executed by only one party (husband and wife considered one entity and either party can bind). In other cases both parties would need to sign. In that case you would sue for "partition." The court would order that the property be sold and the assets divided accordingly.

Speak with an attorney that you make familiar with the situation and they can give proper advice for your situation.

Roger
