Does husband have claim on properties because of payment

My husband and I are seperated. And even though both of us live in different houses, neither wants to file for diviorce right now. During our marriage we acquired several properties that we rent and use as income. He is currently making payments on the properties and recieveing all the income generated from them. My question is that if he continues to make payments and recieve the income will those properties automatically become his, after so much time has passed in the seperation, or will they still be considered martial assets and have to be split when diviorce is filed, regardless of the time?
