Legal Question in Family Law in Pennsylvania
My husband and I are experiencing marital difficulties due to his drinking and gambling. We have been married for 14 years. Because I experienced a devastating marriage in the past, I have a prenuptial agreement. The attorney I worked with prior to my second marriage assured me this document was necessary to protect the interest of my three children, my home and finances that I acquired before marriage. My attorney also suggested that we keep our finances separate, because my husband had filed for bankruptcy, which we have. Therefore, we do not have any joint accounts; however, we have filed joint tax returns.
At this point, I am not sure I want to go through the pain of another divorce; however, a separation is essential in order to try to reconcile.
My questions� since there are no children from this marriage, no joint property and all debut is separate, is a legal separation necessary or can we just live separate and apart?

Well since you live in Pennsylvania there is no such thing as a legal separation. As far as I know only New York has them.
