Legal Question in Family Law in Pennsylvania
Husband is not the father
I am currently pregnant. My ex husband and I were attempting to reconcile several months ago. I became pregnant. He told me he did not want to be a father, suggested and abortion, etc.
After his mother found out I was pregnant he changed his decided he does want to be a father. However he never asks how the baby or I are doing. He shows no real interest or motivation.
A wonderful friend of mine who I have known since high school has asked me to marry him. He wants to provide a stable and loving family for the baby with me. I am having complications with the pregnancy and he wants to be there to make sure all is well.
My ex husband was emotionally abusive to me in the past and was showing the same signs again. My friend and I do not want my daugther to be subjected to this.. What are the biological father's rights if I marry before the baby is born. I have been told he would have none is this true?

Re: Husband is not the father
If you marry before the child is born you would be protected by the most poerful paternity presumption in the nation. Your ex-husband would have to prove non-access or your husband's impotence.
