Legal Question in Family Law in Pennsylvania
My husband & I went for a legal consultation with an attorney regarding child support and custody of his daughter from his first marriage. Specifics were discussed including calculations of child support amounts, requirements for change in custody and details of his ex-'s home life of which he disapproves. We paid for the consultation.
This attorney is now representing his ex-wife in child support hearings and may represent her in custody hearings if that becomes an issue.
We have informed the attorney that we were his clients and told him it was a clear conflict of interest but he disagrees and he continues to represent her at all hearings.
Is this a conflict of interest and can he be removed from representing her?

Even if you didn't retain the attorney, he is conflicted out of representing the other party in the case.
Time to call the disciplinary board.

Since you went for a consultation only, and apparently did not retain him, you are not his clients. However, I would agree that there is a conflict. You can file a complaint with the Bar Association and/or hire an attorney who can also raise the conflict issue. If you still require legal assistance I also offer free 1/2 consultations.
