Legal Question in Family Law in Pennsylvania
My ex husband refuses to give our daughter the medications the doctors want her to have, She is on autism spectrum and is on gluten free diet as well as taking mirolax and melatonin to help her sleep well at night. She also recently was diagnosed with adhd and started meds about 3 weeks ago. My ex has decided to not follow through what is supposed to be done, and told me this weekend that he is "no longer going to enforce the gluten free diet" He also said he will not give any meds without a note from the doctor saying it is medically necessary. I need some help to get the courts to see that he is not looking out for the best interest of our 5 yr old special needs child. He wants to do whatever he wants to suit his needs and tthat is not acceptable.

Assuming there is a custody order in place, you would need file a petition to modify custody. While you're goal is to get dad on board with the child's medical needs such a petition would force him to either explain why he isn't following the Doctor's orders. If he refuses the court may reduce his custody time with the child.
