Legal Question in Family Law in Pennsylvania

Inheritance money?

My husband has said that when his parents die they are willing all their money (estate) to him alone and not me. We have been married over 33 years and still are, isn't half of the inheritance money also mine?

Re: Inheritance money?

No even if there is no will you would not inherit. Given that there is a will you definitely won't inherit.

Re: Inheritance money?

You asked if you were entitled to half of any estate inherited from your spouse's parents.

You are kidding right? You are counting money from the death of your spouse's parents simply because you've tolerated them for umpteen years?

No, you will not inherit. An estate is the property of the decedent to do with as s/he wishes. There is not even any intestacy right of a spouse to such an estate.

Moreover, inheritance does not become marital property unless the heir intentional makes the gift marital property. This means that if there is a divorce 10 years after the estate is received then the heir still does not have to include the devised property as part of the marital assets.

Roger
